Terms of Service

These Terms of Service ("Terms") are between you and Automotivation Enterprises LLC, a Florida limited liability company doing business as Auto Pals USA. They govern your use of the Auto Pals USA website at autopalsusa.com and the vehicle-sourcing services we provide. By submitting a request, paying a deposit, or otherwise using our services, you agree to these Terms. If you do not agree, do not use the services.

1. Who We Are

Auto Pals USA is a trade name of Automotivation Enterprises LLC, a Florida limited liability company based in Pompano Beach, Florida. We help retail clients locate and purchase used vehicles at wholesale prices through dealer-only auctions. References to "Auto Pals USA," "we," "us," and "our" in these Terms mean Automotivation Enterprises LLC operating under the Auto Pals USA brand.

2. Our Services

Once you've submitted a request, completed an intro call, and paid the deposit described below, we will:

Search dealer-only auctions for vehicles matching your stated preferences
Negotiate, bid on, and facilitate the purchase of vehicles on your behalf
Communicate progress through your client portal, email, and (if you opted in) SMS

We do not warrant the condition, history, or future performance of any vehicle. All vehicles are sold as-is from the auction; we strongly encourage independent inspection where possible.

3. Deposit & 60-Day Search Window

A non-recurring $850 deposit is required to begin sourcing. The deposit:

Activates a 60-day search window beginning on the date the deposit is confirmed
Is fully refundable if we do not find a matching vehicle within 60 days
Is non-refundable if you cancel the engagement before the 60-day window expires (per the service agreement)
Is credited toward the final purchase price when you accept a sourced vehicle, in accordance with the signed contract

4. Communications & SMS

SMS is optional — it is never required to use our service. SMS opt-in is captured exclusively through a dedicated unchecked-by-default checkbox at the bottom of the vehicle request form. The form submits and the service is delivered the same whether or not you check the box. Clients who do not opt in receive identical service quality via email and through the secure client portal — there is no functional difference. Providing your phone number is not, by itself, consent to SMS; numbers are used to coordinate scheduled calls. Message and data rates may apply. Message frequency varies based on your individual progress through the sourcing process. Reply STOP at any time to opt out. Reply HELP for help.

How opt-in works

To receive SMS from Auto Pals USA, you must affirmatively check the dedicated SMS opt-in checkbox on the vehicle request form. The checkbox is unchecked by default and is labeled "I agree to receive SMS messages from Auto Pals USA about my vehicle request — booking confirmations, deposit notifications, portal messages, and contract notices." Beneath the checkbox the form states "Optional — leave unchecked and we'll only reach you by email and through the portal." Our server-side SMS pipeline is hard-gated on a per-user consent flag captured at submission; users who did not opt in receive zero SMS messages, ever.

Message types you may receive (only if you opted in)

The kinds of messages we may send via SMS are limited to the following transactional categories:

Confirmation that we received your request, with a link to book an intro call
Up to two reminders within 48 hours if you have not booked the intro call
Notifications when our team posts a message to your client portal
Notification when your service contract is ready to sign
Notification when your refundable deposit is received and your 60-day search window begins

Phone numbers and third-party sharing

We do not share or sell your phone number or SMS opt-in data with third parties for marketing or promotional purposes. Phone-number and SMS-consent information is used only by Auto Pals USA to communicate with you about your vehicle search, and is never shared with affiliates, advertisers, or any other third parties for their own marketing.

The only third parties that ever process the message itself are our carrier-aggregator partners, strictly for the technical delivery of the message you opted in to receive.

Reply STOP (also accepted: STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, REVOKE) to unsubscribe from SMS. Reply HELP for help, or email info@autopalsusa.com. Standard message and data rates may apply through your carrier.

5. Acceptable Use

You agree to:

Provide accurate, current, and complete information when submitting a request
Not attempt to interfere with the operation of the website or its underlying systems
Use the services only for your own personal vehicle-purchase needs

6. Disclaimers & Limitation of Liability

The services are provided "as is" and "as available." We make no warranties, express or implied, regarding the suitability, accuracy, or availability of vehicles located through the service.

To the maximum extent permitted by law, Auto Pals USA's total liability under these Terms is limited to the amount of fees you have paid to us in the prior twelve months. We are not liable for indirect, incidental, consequential, special, or punitive damages.

7. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Broward County, Florida.

8. Changes

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date and, where appropriate, a notice on the website. Continued use of the services after changes constitutes acceptance.
